Summary

The appellant seeks reversal of a decision made by the Burlington Community School District regarding the tuition for Jo Ellen Meerdink.

The student established residency within the district while living with her mother and step-father in May 1978. She then moved in with the appellant, who became her guardian and also lived in the district, while her mother moved to Des Moines.

In early 1980-81, the district begin investigating the circumstances surrounding about ten situations in which students not living with their parents were enrolled in school. These students were invited to speak to the board about their cases. Their request for a tuition waiver was denied, because the board determined the student to not be an actual resident of the district.

The appellant did not successfully carry the burden of proof to show the board acted improperly

The local board's decision is upheld.
