The appellant seeks reversal of a decision made by the Iowa Girls High School Athletic Union executive board to impose an ineligibility based on the transfer rule.
She went to live with her father in the Charles City Community School District and was granted a waiver by the executive board. When it appeared the living situation was going sour, she inquired about her eligibility should she decide to return to her mother's home in the Clear Lake school district. The decision was she would be ineligible for 18 weeks.
The thrust of the Union's argument is that if home life with her father was as serious as she presented, the appellant would have moved with her mother at the first opportunity. This argument is based on mere suspicion and circumstantial evidence.
The board's decision is overruled.
