The appellants seek reversal of a decision made by the Albia Community School District board to combine the teaching of two elementary grade levels under one teacher at the Melrose elementary school.

The issues being appealed are whether the children at Melrose are getting an equal educational opportunity as children in other schools; whether the actions of the board violate Iowa Code 277.28 and 279.8; and whether the actions of the board violate the First, Sixth, Ninth, and Twenty-fifth Sections to Article I of Iowa's Constitution

There was no basis in the record that indicated the performance of Melrose children significantly differed from their peers.

The local board's decision is upheld.
