Summary
Appellants open enrolled their three children after the March 1, 2021 deadline alleging "repeated acts of harassment." The request was denied. The appellants timely appealed to the State Board of Education. The harassment of both J.G. and A.G. was harmful. The district did attempt to resolve the harassment of both J.G. and A.G. Appellants also sought to open enroll a sibling, M.G.
Given the severity of the harassment and the reasonable responses provided by the district, the court concludes that the harassment will "likely continue." The sibling, M.G., was not harassed and the decision is Affirmed on this student. The decision as to J.G. and A.G. must be REVERSED.
