Summary

Appellant appealed a determination that her day care home is seriously deficient and a proposed termination of her agreement to participate in the Child and Adult Care Food Program (CACFP) and proposed disqualification from future CACFP participation.

Appellant acknowledged submitting false claims to Polk County Community, Family & Youth Services (CFYS) in order to receive more reimbursement than she was entitled to receive. ALJ concluded that CFYS correctly determined a serious deficiency existed based on the submission of false claims for reimbursement.

Appellant was required to submit a completed corrective action plan by September 30, 2020.  Appellant claims she mailed the required documents before the stated deadline; however, there is no evidence to support her claim.  CFYS did not receive the completed action plan by the deadline.

ALJ concludes that the Appellant failed to fully and permanently correct the serious deficiency. The CACFP participation agreement between the Appellant and CFYS is terminated and the day care home shall be placed on the national disqualified list.
