The student transferred from Solon CSD to the Iowa City CSD in summer, 2020. He was determined to be ineligible to participate in varsity sports for ninety-days. The appellant's transfer decision was based upon a firm belief that the football helmets at Solon CSD were unsafe. It is believed the reconditioning program is not currently in compliance with the appropriate standards.

The incentive to ensure safety should fall to the school's resources. If a school is unwilling or unable to ensure students safety then a student should be able to participate at another school without penalty. In determining it was "fair and reasonable" to put R.P. in this position, the Board abused its discretion.

The Board's decision is REVERSED
