The Iowa Department of Education received a waiver application from Knoxville CSD on January 16, 2020. On February 3, 2020, the Department received a waive request from Turkey Valley CSD. Both concerned school buses that the applications ordered prior to the effective date of the rule amendments to Chapter 44 in October, 2019.

No hearing was held in this matter. All facts were disclosed on the applications. The amendments to chapter 44 are not mandated by statue or other provision of law. The rules that were in effect at the time these vehicles were purchased provide substantially similar protection of "public health, safety, and welfare" as the rules for which this waiver is sought.

Granting these applications will not have a "negative impact" on student achievement. It is therefore ORDERED that these applications are Granted.
