On or about December 12, 2018, the Collins-Maxwell CSD filed a petition with this agency requesting a waiver from administrative rule 281 Iowa Administrative Code 12.4(4) for a period of two years. A telephonic hearing was held on January 7, 2019. Collins-Maxwell answered questions related to the criterion required for the waiver request.

When a petition for waiver is filed, all five criteria listed in rule 4.4 are satisfied before granting a waiver. The Department finds for the reasons stated on the record at the hearing and for the reasons stated in the Petition that the criteria are satisfied.

For the reasons stated on the record and in the Petition, the waiver is GRANTED until the end of the 2020-2021 school year. At such time, the Petitioner shall reapply to the Department for another waiver or the Department may, in its sole discretion, renew the waiver at any time if the agency finds all of the factors set out in subsection 2 remain valid
