Summary

Appellant seeks reversal of a decision made by the Iowa High School Athletic Association (IHSAA) Board of Control finding that T.M. is ineligible to compete in varsity interscholastic athletics for 90 consecutive school days under the provisions of the general transfer rule (IAC r.281-36.15(3)).

The IHSAA requires students who transfer into a new school district to serve a 90-day suspension from varsity interscholastic athletic activities. After reviewing the evidence submitted and testimony, the IHSAA Board of Control determined that T.M. did not meet any of the exceptions to the transfer rule and, therefore, an exception should not granted.

ALJ and Department of Education (Department) have jurisdiction of the parties and of the subject matter. Both ALJ and the Department concluded that T.M. meets an exception to the general transfer rule.

The decision of the IHSAA, made on June 11, 2018 is REVERSED.
