On or about August 15, 2017, Complainants C.B. and L.B. filed a due process complaint against Respondents/District and the Area Education Agency. Hearing in this matter was held on April 2 through April 5, 2018 at the AEA Office.

The Issues were whether the IDOE violated the IDEA and failed to provide C.B. a Free and Appropriate Public Education (FAPE) by failing to implement the terms of the legally binding agreement signed on February 8, 2016. Also, whether the IEP and BIP proposed by District constituted a denial of FAPE and violated the IDEA.

Complainants have not proven that Respondents denied Student a free appropriate public education as alleged in the due process complaint. Complainants' requested relief is therefore denied and the due process complaint is dismissed.
