Summary

Parents seek reimbursement of education and travel-related costs following unilateral placement of high school student in private out-of-state academy. Student has above average intelligence; is diagnosed with ADHD, dysgraphia, and a nonverbal learning disorder; and has a significant processing speed deficit.

Parents allege that the public school district failed to adhere to the procedural safeguards of the Individuals with Disabilities Education Act (IDEA) and denying the student a free appropriate public education (FAPE) by failing to implement accommodations required by the student's individualized educational program (IEP), including:

reduction of work load, extended time to complete assignments and assessments, and alternate forms of assessment; as needed to for student to successfully complete honors courses.

The Respondent school district and AEA prevailed on all issues.

School district complied with the procedural requirements of the IDEA and offered an individualized educational program (IEP) sufficient to provide the student with FAPE.

Extensive accommodations consistent with the IEP and recommendations in educational evaluations were implemented to the highest degree possible without compromising the nature of the accelerated courses in which the student was enrolled.
