The appellant seeks reversal of a December 17, 2007 decision made by the Waukee Community School District local board denying the open enrollment application filed on behalf of Nicole P.

Nicole P. lives in the Waukee School District and attends high school as an 11th grader in the ADM District. An open enrollment application was filed on her behalf by Nicole's mother on August 23, 2007 (the second day of school at Waukee), alleging incidents of harassment that occurred from November 2006 through mid-March, 2007.

It is determined the criteria by which Nicole should be allowed to open enroll from Waukee have not been met. The alleged harassment had ceased. Because no acts of harassment are reported after March 11, 2007, there is no legal excuse for the late-filing of the open enrollment application herein.student.

The decision of the local board denying the open enrollment application is correct. IT IS FURTHER RECOMMENDED, due to the sensitive nature of the matters discussed in the record, that the Board go into closed session pursuant to Iowa Code section 21.5(1)(f) "to discuss the decision to be rendered in a contested case conducted according to the provisions of chapter 17A."
