Summary

The Appellant and her children moved to Iowa from out of state prior to the 2008-09 school year. Terence is a senior, lacking just 4 credits to graduate. Chase is a sophomore. Although both are on track to graduate on time, their mother seeks an additional year of eligibility for both of them to improve their academic standing and self-confidence.

Additional semesters of eligibility for interscholastic athletics are governed by administrative rule 281?IAC 36.15(2)"e". This rule gives to each student the equivalent of eight consecutive semesters, commencing immediately after successful completion of 8th grade, of such eligibility. Additional eligibility has never been granted in a case where the student could graduate with his class but chooses not to do so. There are no compelling circumstances to justify doing so here.

The decision of the IHSAA to deny additional semesters of eligibility is affirmed.The decision was appealed to District court and the decision of the IHSAA to deny additional semesters of eligibility is affirmed.
