At issue in this matter is the requirement that "[s]chool districts that share operational functions with other school districts must be contiguous districts.

The petitioner proposes to share services of a superintendent with Hartley-Melvin-Sanborn Community School District. The two district are not contiguous, because they are separated by South O'Brien Community School District.

The waiver is granted, as the intent of the contiguous requirement is not harmed by granting this waiver.
