Summary

The appellant seeks to reverse a decision made by the Iowa High School Athletic Association Board of Control finding student Derek Sears ineligible to participate in interscholastic athletics for 90 days in keeping with the general transfer rule.

The student lives on his own with some financial assistance from his grandparents and a part-time job. He would like to participate in sports immediately, and the appellant has him listed as a homeless student. The board found he was not homeless for the purposes of athletic eligibility.

The general transfer rule requires the board to consider the factors that led up to the residence change and created the ineligibility; the change must occur for the reason of making a home and not solely for school or athletic purposes. The student has admitted the move was solely for school reasons.
