Tara, a 9th grade student, is attending Hempstead High School. She attended lower grades in nonpublic school. Appellants presented the "instability of the Holy Family School System in Dubuque" as a factor behind the transfer and submitted newspaper articles as exhibits. Tara testified that her transfer was motivated by the fact that her friends had transferred to Hempstead and she wanted to be able to be on sports team with them.

Tara participated in softball for Wahlert High School over the summer months. Under the General Transfer Rule, Tara is ineligible to participate in sports due to the fact that there was no change in residence by her parents after she began participating in the summer.

That the decision of the Board of Control of the IGHSAU was affirmed.
