Appellant was appealing from a decision of the superintendent that determined her daughter, who was an intra-district transfer student, was ineligible to compete for one calendar year in any interscholastic athletic activity at the school. Appellant appealed to the local school board during the public comments segment of the meeting. The board took no action regarding the situation.
Intra-district transfers are not governed by the Department of Education. 281 IAC 36.15(3"d" states that a school district shall set its own eligibility policies regarding intra-district transfers. The policy of the Cedar Rapids School Board states that the superintendent's decision shall be final.
This is not to say Appellant had no recourse. An action may be filed with the local state district court if she wished to pursue this matter.
The notice of appeal filed by Appellant was dismissed for lack of jurisdiction under Iowa Code 290.1.
