Based solely on Peter's admissions, he possessed marijuana on school premises in violation of District Policy 504.2. He had given an unspecified quantity of the drug to a fellow student as well. School administrators recommended to the local board that Peter be expelled. On January 16, 2003, the District held an expulsion hearing and voted to expel Peter from the District for the remainder of the 2002-03 school year.
Appellants raised 5 procedural due process arguments. They also raised the substantive issue of the expulsion being an excessive penalty for a first-time offender. The administrative law judge found that the District Board had given Peter due process and agreed with their findings.
That the decision of the Board of Directors of the Waterloo Board of Directors made on January 21, 2003, was affirmed.
