Summary

"DJ" has resided in Cedar Falls at all times pertinent to this appeal. He attended the Price Lab School in Cedar Falls in the past. Currently he is a 10th grade student in the District's high school. His transfer was made for 2 reasons: an increase in tuition and questions about the sufficiency of the mathematics curriculum and the uncertainty of the future of the Price Lab secondary classes. IHSAA relied on 281 IAC 36.15(3) when it determined DJ was ineligible to compete at Cedar Falls High School. None of the exceptions listed in the General Transfer Rule applied to this case.

Evidence showed DJ's reasons for transferring were not motivated by school jumping or recruitment. The transfer rules are applicable and controlling and reasonably related to achieving the IHSAA's purpose in deterring school jumping and recruitment.

That the September 4, 2002, decision of the IHSAA that DJ was ineligible for 90 school days at Cedar Falls High School was affirmed.
