Appellee is the receiving district in this appeal and is located in the Loess Hills Area Education Agency. The Director of the Special Education Services at AEA 13 was asked by the Administrative Law Judge to determine whether A-H-S-T was able to provide an appropriate special education program for Phillip.

The Director notified the Administrative Law Judge by letter dated April 17, 2002, that "it is the decision that the special education needs of Phillip Houston can be met by A-H-S-T Community Schools."

That the decision of the Board of Directors of the A-H-S-T Community School District made on January 21, 2002, denying Phillip Houston, was reversed.
