Summary

Travis is a junior enrolled at Davenport Assumption High School. He resides with his maternal uncle and aunt, who are Travis' temporary custodians. Travis' parents have been divorced since 1992, with his mother maintaining custody. Travis' mother and father both remarried in 1999. His father suffered a heart attack in July 1999 at which time Travis moved back to his mother's home.

Travis attended high school in LaPorte, Indiana, throughout his freshman and sophomore years and completed the first semester of his junior year there as well. He participated in football and wrestling at LaPorte until he was declared ineligible for one year in February 2000. The violation was for marijuana use.

Travis moved in with his aunt and uncle in Davenport and began attending Assumption on December 20, 2000. Travis' uncle asked the Board of Control to declare Travis eligible under the "broken home" rule. Affidavits from Travis' mother and psychologist were introduced as evidence.

The Board of Control did take into consideration when declaring Travis ineligible the fact that Travis' violation of the good conduct policy resulted in his ineligibility to compete until February 2001.

That the decision of the Board of Control was affirmed.
