Summary

The Jeongs are residents of the United Community School District. Mr. Jeong is an associate professor at Sogang University in Seoul, Korea, and the entire Jeong family will return to Korea by the end of February 2001. Mr. Jeong's daughter, Ji Yoon, attended sixth grade in the United District during the 1999-2000 school year. Mr. Jeong requested open enrollment for Ji Yoon to the Ames Community School District beginning with the 2000-2001 school year because he feels Ames has a better ESL program and there would be more Korean children with whom Ji Yoon could interact.

Each year since November 1990, the Ames Board of Directors has declared insufficient space and has not allowed students to open enroll into its junior high and high school levels. The District denied Mr. Jeong's request on April 10, 2000, on the basis of insufficient classroom space.

The Board's determination that it should first look at the needs of its resident pupils is reasonable and is to be supported. The Board applied its open enrollment insufficient classroom space consistently and to allow Ji Yoon into the District would violate the policy. The District correctly looked at the impact of not just Ji Yoon's application, but of all similarly situated applicants.

That the decision of the Board of Directors of the Ames Community School District, made on April 10, 2000, that denied Appellant's request to his daughter to open enroll into the District, be affirmed.
