Summary

Jared is a 17-year-old junior attending Dowling High School. The family lives in Urbandale Community School District. Jared attended parochial schools from first grade through tenth grade. He participated in Dowling's basketball and spring soccer programs in high school. In August 2000, Jared decided to attend the Urbandale District and attended approximately 3 weeks when he realized that he had made a mistake. He wasn't comfortable with the new student population at Urbandale.

Jared's parents were told by the Dowling administration that students were prohibited from transferring in the middle of a quarter, thus forcing Jared to complete the first quarter at Urbandale. Jared attended Urbandale for 40 school days and is seeking to compete in athletics at Dowling.

The Association's Board of Control allows a student athlete an adjustment period of 30 school days to change his mind and go back to his prior school. Dowling refused to allow Jared to transfer in the middle of a quarter. The family contends that the 40 days of attendance at Urbandale should, therefore, count toward the 90-school-day ineligibility period at Dowling.

We conclude that the applicable rule governing this appeal is 281--IAC 36.15(5)(c). We agree with the Association that the 90-day ineligibility rule and uniform application of that rule without exception is very important.

That the decision of the Board of Control of the IHSAA was affirmed.
