Summary

During Mark's freshman and sophomore years he resided with his parents in the Bettendorf District. However, due to personal relationship problems with his father, Mark moved in with family friends in the West Des Moines District. This move was motivated solely by his desire to make a home for himself, away from his father. He is not receiving financial assistance from his parents. He has a job and works approximately 15 hours per week. Mark has every intention of staying in West Des Moines even after graduation and continuing to make it his home.

Mark would like to complete in Valley High School's swimming program during his senior year. IHSAA's Board of Control declared Mark ineligible to compete for 90 school days under the General Transfer Rule (281-36.15(3). It was found that none of the exceptions to the General Transfer Rule applied to Mark.

That the decision of the IHSAA's Board of Control issued on October 28, 1999, was affirmed.
