Summary

In 1996,the family relocated to a relative's home in the Jessup School District because of repossession proceedings against their Waterloo home. The family moved back to their Waterloo residence in July of 1998. Mrs. Hanson completed an open enrollment application on July 31, 1998.

On August 17, 1998, the family moved into a friend's residence in the Dunkerton District due to a fire. Ms. Hanson did not report the fire and there was no evidence presented at the hearing to substantiate the fire. On August 17, 1998, Ms. Hanson filed an application with the Waterloo District. The Board denied the application on September 14, 1998, because it was filed late.

The family moved back into their Waterloo residence on February 22, 1999 and Ms. Hanson filed a second open enrollment application with the District. This application was denied on March 22, 1999. Ms. Hanson's applications for the 1998-99 and the 1999-2000 school years were both filed past the deadline. The Board followed the law and departmental rules when it denied both applications for being untimely filed.

The Board specifically found that Ms. Hanson's application for a continuation under the Open Enrollment Law was not valid because she never changed her residence from the Waterloo District. Dunkerton was never the "original district of residence" for the Hanson family.

That the decisions of the Board of Directors of the Waterloo Community School District, denying Kenneth Hanson open enrollment to Dunkerton was affirmed.
