These appeals were consolidated because they involved common questions of law and of fact. These non-minority students were denied open enrollment out of the Des Moines District beginning in the 1999-2000 school year under the provisions of the District's Desegregation Plan. After reviewing the application of the District's policy to these Appellants, the administrative law judge found that the decision of the Des Moines Independent Community School District Board was appropriate under the Law.

The decision of the Board of Directors of the Des Moines Independent Community School District made on January 19, 1999, denying Appellants' open enrollment applications for their children for the 1999-2000 school year, was affirmed.
