Appellants are residents of the East Monona Community School District and filed open enrollment requests for their two daughters on December 17, 1998. The superintendent of the District testified that he recommended approval of the applications at two different Board meetings, but the Board is concerned about the number of students the District is losing due to open enrollment. The Board knowingly acted unlawfully and outside of its authority.
The Board knowingly acted unlawfully and outside of its authority. Therefore, the administrative law judge and the hearing panel recommend the decisions of the Board of Directors of the East Monona Community School District on January 11, 1999, denying Appellants' applications for open enrollment be reversed.
