Ashley Glover attended Price Laboratory School under open enrollment from grade 1 through grade 7. Ashley is a minority student who was assigned to attend West High School in the Waterloo District. West High School has a minority enrollment of 20.6%. Since that figure is at least 5% less than the District's average of 30.6%, Ashley was deemed ineligible to leave the District.

The evidence did not show that the Board's policy was incorrectly or inappropriately applied to the facts of Ashley's case.

That the decision of the Board of Directors of the Waterloo Community School District made on January 15, 1999, denying open enrollment for Ashley Glover was affirmed.
