Summary

These appeals were consolidated and heard together. All Appellants are residents of the Burlington Community School District who timely filed applications for their children to open enroll out of the District for the 1999-2000 school year. The District has a policy that provides that applications for all students requesting a transfer out of the District will be denied if the release of the student (minority or non-minority) will adversely affect the District's "composite ratio". The District's minority enrollment for the 1998-1999 school year was 15% and the non-minority enrollment was 85%, resulting in a composite ratio of 1:7.

All Appellants were denied because their applications exceeded the allowable ratio. The administrative law judge found that the District's policy, as well as its application to the Appellants in this case, was consistent with the law and should be affirmed.

That the decision of the Board of Directors of the Burlington Community School District, made on January 25, 1999, that denied open enrollment requests for Taylor Ballard, Alexander Beames, and Jordan Marie Gerst for the 1999-2000 school year, be affirmed.
