Summary

Appellant's home is in a rural area and the assigned attendance center for elementary students in that part of the District is the Lockridge Elementary School, about 10 miles from Appellant's home. Devan will be in kindergarten in the fall of the 1999-2000 school year. Devan has trouble adjusting to new people and situations and has experienced respiratory problems. Because of those factors, Appellant wanted Devan to attend Washington Elementary School, which is closer to her home and her place of employment. The Board denied her request. The Administrative Law Judge found that under the provisions of Iowa Code section 279.11, local boards of directors have the authority to determine the attendance center for each student. In the present situation, the Board properly applied its policy to maintain uniform class sizes throughout the District while considering the educational needs of students and transportation requirements.

The decision of the Board of Directors of the Fairfield Community School District made on March 15, 1999, denying Catherine Wright's request to allow her son to attend attendance center other than his assigned attendance center, was affirmed.
