Summary

After an unhappy 9th grade year, Appellant's daughter was extremely reluctant to return to 10th grade in the same high school. Appellant did not become aware of her daughter's distress until August, before school started. Appellant initially tried to transfer her daughter within the District to another high school. When she was advised that was not possible, she filed an open enrollment application and registered her daughter at North Scott Community School District for the 1998-99 school year. The Board denied Appellant's open enrollment request at its meeting on August 24, 1998. However, the Board allowed the intra-district transfer. Since August 24 was also Ashley's first day of school in the North Scott Community School District, Appellant no longer was interested in the intra-district transfer and appealed the Board's denial of her open enrollment application. The hearing panel determined that the Board properly found that there was no statutory good cause for the late-filed application.

The decision of the Board of Directors of the Davenport Community School District, made on August 24, 1998, which denied Appellant's request for Ashley Tilton to open enroll to the North Scott Community School District for the 1998-99 school year, be affirmed.
