Mr. and Mrs. Vedral are residents of the Sioux City Community School District. Their son, Thomas, attended a private high school during his freshman and sophomore years. The Vedrals testified that Thomas had been subjected to harassment by a group of students and felt they had no choice but to enrolled Thomas into the public school system. The Vedrals requested that Thomas be eligibility for extra-curricular activities due to the circumstances. However, the Board of Control of the Iowa High School Athletic Association denied their request. The Vedrals appealed to the Director of the Department of Education.
The eligibility rules are contained at 281 Iowa Administrative Code 36.15. The 90-day ineligibility rule and uniform application of the rule is very important so school districts, students and their families understand the consequences of a transfer decision.
The hearing panel and administrative law judge determined that the Board of Control acted appropriately in denying eligibility for extra-curricular activity competitions to Thomas Vedral for a 90-day period due to his transfer.
