Appellant timely-filed for open enrollment for his children to attend school in the West Burlington Community School District for the 1998-99 school year. The applications were denied under the composite ratio portion of the District's open enrollment policy. The portion of the Burlington open enrollment policy applied in this case was identical to the policies applied by both the Des Moines and Waterloo Districts which have been upheld on appeal to district court. Therefore, there was no basis upon which to overturn the application of the policy in this case.

It was recommended that the decision of the Board of Directors of the Burlington Community School District made on January 26, 1998, denying the Shofe children's open enrollment requests under the District's desegregation plan, be affirmed.
