Summary

According to Iowa Administrative Code 3.5, this agency may deny a petition for declaratory ruling when "...(t)he questions presented...would more properly be resolved in a different type of proceeding or by another boy with jurisdiction over the matter"

This petition is denied because the procedures for an appeal brought under Iowa Administrative Code 290 would more appropriately address the application of this policy in a factual context.

When students are penalized under this policy, the parents must exhaust all administrative remedies by presenting the issue before the school board, then filing an appeal with the Department of Education if the decision is unsatisfactory. All the issues raised in this petition may be addressed in a ruling affirmed by the State Board of Education.
