Summary

Appellant moved to Scranton in August 23, 1998 and prior to that, he had lived in Pennsylvania with his mother. In January 1999, his mother made arrangements to move to Churdan. Appellant had contacted Paton-Churdan while living in Pennsylvania and upon his return on August 23, 1998, he gave his open enrollment to the superintendent of Paton-Churdan. That evening, the superintendent presented Appellant's application to the Board, which denied his application as being untimely filed.

The three districts in Greene County have a longstanding agreement regarding open enrollment. The agareement is that students are able to open enroll freely among the districts prior to the first day of classes in the fall. This agreement does not exist in writing, but was in effect in 1995 and has been followed consistently by the Board.

Appellant's application was untimely and he did not dispute that fact. Rather he maintained that the Board's decision was unfair because it approved six other late-filed applications, but denied his application. In applying the standard of review to othis appeal, the questions becomes whether the Board's decision was reasonable.

Appellant's application was denied because it did not comply with the Board's first-day-of-classes deadline. The Board cannot fault the Board for consistently enforcing its practice.

That the decision of the Board of Directors of the Jefferson-Scranton Community School District, made on August 24, 1998, was affirmed.
