Ryan and Christine Rand sought reversal of a decision of the Board of Directors of the Cedar Rapids Community School District made on January 12, 1998, which denied their application for open enrollment for their daughter, Khloe, to attend kindergarten in the Mt. Vernon Community School District. The denial was based upon a finding that the transfer would adversely impact the District's desegregation/integration plan. The District's policy denies an open enrollment request if the transfer would "raise or sustain the minority enrollment of the District attendance center within ten percent of the Department of Education's guidelines...". Monroe Early Childhood Center is Khloe's attendance center for kindergarten and the minority population is 26% for the 1997-98 school year. Therefore, Appellants' application was denied since Khloe is a white student whose departure from Monroe would increase the ratio of minorities to the overall attendance center's population.
Finding no error in the District's application of its desegregation/ integration plan in the denial of Appellants' open enrollment application, the Administrative Law Judge and hearing panel recommended that the decision of the Board of Directors of the Cedar Rapids Community School District made on January 12, 1998, denying the Rands' request for open enrollment for their daughter, Khloe, for the 1998-99 school year, be affirmed.
