Summary

Jeremiah attended private christian schools through 6th grade. In 7th grade, Jeremiah attended Meredith Junior High and experienced difficulty adjusting to the public school system and his peers. His mother homeschooled Jeremiah during his 8th grade year and wanted to open enroll him to the Johnston School District.The District denied Ms. Simms-Davis' application on the basis that it was filed late and there were no grounds for the good cause exception.

The Des Moines District publishes the open enrollment deadlines in a school newsletter and in the "Des Moines Register". The District is not responsible for making sure that every parent in the District actually receives the notice and actually reads it when it is sent.

There was no error seen in the decision of the Board of Directors and there are no grounds to justify reversing the District Board's denial.

That the decision of the Board of Directors of the Des Moines Independent Community School District, made on May 20, 1997, denying open enrollment to Johnston School District for Jeremiah Simms-Davis, was affirmed.
