Summary

Appellants timely filed their application for Eavan to attend Riverdale Heights Elementary School, which is a new school presently under construction and only .6 mile from their home. Bettendorf approved the application out, but Pleasant Valley denied the application in due to insufficient classroom space. Pleasant Valley has been receiving students at the junior high and high school levels.

Although the Hamiltons cannot be denied open enrollment into the District, they can be denied admittance to the Riverdale Heights Elementary School. Nonresident students should not enjoy greater rights than those enjoyed by resident students

That the decision of the Board of Directors of the Pleasant Valley Community School District to deny open enrollment to the Hamiltons was reversed. However, the District has an absolute right to assign the pupil to whatever attendance center it feels necessary to equalize the District's educational opportunities.
