Misty applied to Centerville to complete her final semester of education to "escape harassment by both students and faculty." An instructor was overheard making derogatory remarks about Misty to other students; while Misty walked to and from school, students driving cars would swerve as if trying to hit her; and she had been threatened with physical assault by other students.
Mr. Deal commented that his son had also been subjected to harassment. Brad did not request open enrollment because he was reluctant to leave a familiar environment. The local board did not feel Misty's situation constituted "good cause" as defined by the Code.
The rules do not expand the meaning of "good cause," and in this case, the State Board is not being critical of Appellant's reasons for wanting open enrollment. However, the stated reasons do not meet the good cause definition.
That the decision of the Board of Directors of the Moravia Community School District denying Misty Deal's request for open enrollment was affirmed.
