A change in Bryan's custody occurred on August 1, 1994. Bryan's father applied for open enrollment to Wilton and was denied on July 18, 1994, because the request "did not follow the proper time lines set by the Iowa Code." Bryan's step-brother attended Wilton as a senior and the boys had become good friends. Iowa Code section 282.18(18) defines "good cause" as "...a guardianship proceeding, ... ." Unfortunately, the Court's Modification of Custody Decree was not rendered until July 13, 1994 and there was no way for Appellant to comply with the June 30th deadline date.
The State Board exercised its authority under subsection 282.18(20) and overturned the District Board's denial from West Liberty to Wilton Community School District.
That the decision of the Board of Directors of the West Liberty Community School District denying Bryan Swift's open enrollment request was reversed.
