Summary

The appellant seeks reversal of a decision made by the Grant Wood AEA Board denying the district's request to travel across portions of the Anamosa Community School District on regular bus routes.

The district lies to the south and west of Anamosa, and it uses Highway 1, which goes through Lisbon Community School District as well as Anamosa, because it is the safest route. It has been doing so based on an informal agreement and without AEA approval.

In October 1993, Anamosa's school board a resolution not to allow Mt. Vernon's buses into it's borders. In response, the district asked the AEA Board to approve its route into Anamosa, on the basis that the request was not on the basis of transporting open enrollment students but for reasons of safety and economical efficiency. The AEA Board denied the request.

Because there is insufficient evidence that neither economic efficiency or safety issues require the district to cross into Anamosa, and there is considerable evidence that the route may have been customized to transport open enrollment students, the decision of the Grant Wood AEA is affirmed.
