Summary

The appellant seeks to reverse the decision made by the Farragut Community School District board to terminate the sharing agreement with Hamburg School District for the services of Superintendent Leo Humphrey.

From 1987-88 to 1990-91, Farragut ("the district")shared a superintendent with Hamburg. The district held the contract and received 50% of its costs from Hamburg. Near the end of the fifth year, the district decided not to renew the superintendent's contract, and it was suggested it be held by Hamburg; Hamburg agreed.

The appellant disagreed with the local board's decision to terminate the sharing agreement that saved the district money to hire a new full-time administrator, believing the decision to be fiscally unsound. She also believed the district was motivated to get rid of Humphrey regardless of cost or his above-average performance evaluations.

On March 9, the board heard public comments on the issue of the continuing the superintendent sharing agreement. On March 11, the board held a joint meeting with Hamburg on the issue; Hamburg unanimously voted to continue the agreement, while the district unanimously voted otherwise.

The State Board has rejected appeals involving a straight decision not to renew a superintendent's contract, unless it is the superintendent that filed the appeal. In this case, the board's decision involved more than a contract, but also a sharing agreement that saved the district money.The appellant has not carried the burden to prove the board's decision was arbitrary or capricious, an abuse of discretion, without basis in law or fact, or in excess of the board's legal authority.

The decision of the Farragut Community School District board to terminate the sharing agreement with Hamburg Community School District for the services of Superintendent Leo Humphrey is affirmed.
