Summary

The appellant is seeking reversal of the Glenwood Community School District's board to lease the Meyer school building located at the Glenwood State Hospital.The District struggled with overcrowded facilities during recent years while educating approximately 1900 students in kindergarten through twelfth grade. There were issues with food service, adequate testing space, etc. After a third unsuccessful attempt to secure a bond issue for additions, the Board reviewed the following options at its October 14, 1991 meeting:1. Live with existing conditions2. Have another bond election in the near future3. Have another bond election after two years4. Adjust bond issue5. Consider other buildings/facilities available in the district6. Move in more modulars

In their deliberations, the board determined the first four options were not viable as the problem needed immediate attention, and the last option was costly plus was not conducive to educating students with special needs. It was decided to pursue available buildings in the area; the district met with the Department of Human Services to discuss leasing the Meyer school building at the Glenwood State Hospital. A public hearing took place on February 3, 1992.

The Board and administration were made acutely aware of concerns about this plan and proposed a security plan to alleviate them. On May 11, 1992, the Board voted its approval to lease the building. The appellant claims the Board did not take the other options into consideration, that she was dissatisfied about the adequacy of the precautions taken to ensure the safety and well-being of the students and staff, and that the public did not approve the funds spent to renovate the building.

The decision made by the Glenwood Community School District board to lease the Meyer school building located at the Glenwood State Hospital is affirmed.
