The appellant seeks reversal of a decision made by the South Clay Community School District to expel his daughter for the remainder of fall semester with conditions placed for readmission during second semester.
The student caught authoring a "death threat note" to a staff member, which she said was written as a joke. Because of this and past history of absenteeism and misconduct, the superintendent recommended expulsion before the local board of education. The board voted unanimously to expel her for the first semester, and listed the following as conditions for readmission for second semester:1. No absences or tardies2. Perfect behavior 3. Possible counseling
The decision of the South Clay Community School District board of education is affirmed regarding the expulsion; the "perfect attendance" condition for readmission is overturned; and the "perfect behavior" condition for readmission is remanded to the local board for further review.
