Summary

The appellant seeks reversal of a decision made by the Ottumwa Community School District expelling her son for the balance of the 1989-90 school for assaulting a teacher.

The student hit a teacher two weeks after an altercation with another student and having been warned by the principal of the consequences for any further incidents. He was suspended for ten days, and the local board voted to expel him on October 16, 1989, for the remainder of the school year with conditions for readmission. The local board did not create any written findings of fact and did not provide a copy of the decision to appellant. Lastly, it did not offer the student the option of attending the alternative high school

The issue is remanded to the local board to consider the following options for the student:1. Second semester enrollment in the alternative school2. Payment of one semester tuition to a district that will accept him, exclusive of transportation or parental reimbursement of transportation.
