The appellants seek to be excluded from the whole grade sharing agreement between Hubbard Community School District and Radcliffe Community School District on the grounds of educational needs programming and the absence of consideration of geographical factors; they wish to enroll their children in the Iowa Falls Community School District.
They submitted information about the oldest child as evidence for the educational needs programming argument. He met the criteria for pull-out enrichment program during second grade, but it is not available within the sharing agreement for third grade. It would be an option again beginning in fourth grade. Iowa Falls had the Talented and Gifted program that would be available to him in third grade.
There is justification for the oldest child to be excluded from the sharing agreement due to this educational programming need.
Hubbard is directed to pay Iowa Falls an amount equal to the tuition established in the Hubbard-Radcliffe agreement for John Gilbert for the 1988-89 school year.
