Summary

The student was expelled for the remainder of the spring semester due to repeated acts of defiance. The appellant withdrew him from school and enrolled him in a Missouri school district. The Oskaloosa local board proceeded with the hearing to expel the student despite his withdrawal. The superintendent stated there was a previous situation where a student dropped out of school after being made aware of a pending expulsion, the re-enrolling a few weeks later when there was no follow-through with the expulsion.

The board did not consider tabling the issue or passing a motion saying the expulsion would be effective should the student return to the district.

The sole issue to be considered is whether a board can expel a student who is no longer enrolled in the district. It is decided this action is without authority, making it null and void.

The decision made by the local board is reversed.
