The appellants seek review of a decision issued by the Mar-Mac Community School District denying their request to find the district's all-day kindergarten program inappropriate for their son, and to effect a land exchange so they would reside in the MFL Community School District.
Their son has health issues, which caused him to absent often. His doctor agreed that an all-day kindergarten might exacerbate his condition; however, he did not conclude that a lesser schedule was a medical necessity.
The student's physical tendency toward illness and absenteeism is not a sound enough basis to order the district to change its program or to pay for his tuition to another district ... absent other factors.
Regarding the denial of the land exchange request, there is no abuse of discretion or arbitrary action found against the local board.
The local board's decisions are affirmed.
