Summary

The appellants seek review of a board decision issued by the Lakota Consolidated Community School District about the appropriateness of its educational programs.

The district offers enrichment activities rather than have a talented and gifted program. It has been determined the enrichment activities are not appropriate for the students in question. Also, this was heard previously and remanded back to the district for further action; no action had been taken.

The district is to reimburse the tuition paid by the appellants to Buffalo Center-Rake Community School District. The district has the option of correcting the deficiencies identified and providing evidence of this to the Department of Education, or entering into a sharing agreement with BCR, or by paying the maximum tuition for the student to attend BCR as a non-resident student.
