Summary

The appellants seek reversal of a decision made by the Lakota Consolidate Community School District to the effect that the District is providing adequate instructional programming for their daughter.

They have removed her from Lakota and enrolled her as a non-resident tuition student at North Kossuth Community School District. She is considered to be talented and gifted after having been tested. No teacher in the district is qualified to teach the talented and gifted.

The sole issue is whether the district can provide appropriate instructional programming for appellant's daughter.

As of the hearing date, the district was not providing instructional programming appropriate for appellant's daughter. It can either immediately correct the deficiencies in its programming or enter into a sharing agreement with North Kossuth, or pay the maximum tuition to North Kossuth for her benefit.
